  1. General rules:

(a) These “General Terms and Conditions” – hereinafter referred to as: GTC – regulate the conditions for using the Carpe Diem Guesthouse accommodation operated by the service provider at 3413 Cserépfalu, Berezdalja út 56 and the related services provided by the service provider.

(b) These GTC do not exclude the conclusion of special or individual agreements with travel agencies, travel brokers, tour operators, or other persons who cooperate with the service provider on a long-term basis in order to sell the service provider's services.

 

  1. The contracting party:

(a) The contracting party is a natural person, legal person or business association without legal personality who orders the services of the service provider and uses them through the accommodation reservation systems and the website, who acknowledges the GTC and accepts them as binding on him/her. The contracting party is also the natural person who actually uses the service of the service provider. The person ordering and/or using the service is hereinafter collectively referred to as: guest.

(b) Service Provider under the terms of these GTC is Carpe Diem Guesthouse, hereinafter referred to as Service Provider

(c) The Service Provider and the Guest – if the conditions are met – become contracting parties to the service agreement as necessary – hereinafter collectively: contracting parties.

 

  1. Acceptance of terms and conditions

The Guest's acceptance of the Terms and Conditions is a prerequisite for making a purchase or using the service. The Guest's use of the service provided by the Service Provider constitutes acceptance of the Terms and Conditions.

 

  1. Scope of contract terms

The Service Provider reserves the right to modify the General Terms and Conditions in whole or in part at any time. The General Terms and Conditions shall remain in force as long as the Service Provider provides the service. These General Terms and Conditions shall be effective from August 26, 2024 for an indefinite period.

 

  1. Territorial scope of the service

The service operated by the Service Provider is available both domestically and internationally.

 

  1. The creation of the service contract, the process of requesting a quote and booking, and modifying the booking:

(a) The Guest may indicate his/her intention to make a reservation to the Service Provider via the booking system of the carpediemvendeghaz.hu website, as well as by e-mail or telephone. A reservation made on the website is the fastest and safest way to reserve accommodation.

(b) The reservation becomes final when the Guest pays the full accommodation fee (100%). The payment also constitutes acceptance of the Booking and Cancellation Conditions and the GTC. Payment can be made:

– via the website's booking system by bank transfer or online credit card payment.

(c) If the 100% requested by the Service Provider to confirm the reservation is not paid by the agreed deadline, the reservation may be canceled.

(d) If the Guest indicates their intention to make a reservation by phone or e-mail, it will be finalized upon written confirmation from the Service Provider and payment of the full accommodation fee (100%). Failing this, the reservation will not be considered valid.

(e) The reservation is for a fixed period, which applies to the period of stay indicated in the confirmation.

(f) If the guest decides before the expiry of the fixed period that he does not wish to use the service until the expiry of the fixed period and permanently leaves the guesthouse, he is still obliged to pay the full price of the service to the service provider, and the service provider is entitled to demand the full price of the ordered service. The service provider is entitled to resell the guesthouse left by the guest before the expiry of the fixed period.

(g) The Guest is only entitled to extend the service if the service provider consents to this in writing no later than the day before the expiry of the fixed period.

(h) The service contract may only be amended or supplemented by the written consent of the contracting parties. Any modification of a reservation that has already been finalized and confirmed (e.g., rescheduling to another date) is only possible in writing, subject to available capacity.

 

  1. Cancellation conditions:

(a) The Guest (customer) may cancel their accommodation reservation only in writing, by sending an e-mail to info@carpediemvendeghaz.hu. The cancellation is only valid if it has been confirmed by the Service Provider.

 

(b) If the cancellation is made up to 15 days before arrival, the full amount of the reservation will be refunded. The refund will be made within 15 days.

 

(c) If cancellation is made between 7 and 14 days prior to arrival, 50% of the booking fee will be charged as a cancellation fee. The remaining 50% will be refunded within 15 days.

 

(d) If the cancellation occurs within 6 days prior to arrival, the full amount of the reservation is due to the Service Provider, no refund is possible.

 

(e) The Service Provider reserves the right to establish cancellation conditions that differ from the above in the case of special offers or promotional bookings, set out in an individual contract.

  1. Prices applied by the service provider:

(a) The valid prices of the guesthouse are those displayed on the website www.carpediemvendeghaz.hu.

(b) The service provider is entitled to freely change its prices at any time without prior notice, provided, of course, that this does not apply to prices that have already been offered in a quote provided at the request of the contracting party.

(c) When communicating prices, the service provider is obliged to indicate the tax content of the prices – e.g.: general sales tax, tourist tax – as determined by law. The service provider reserves the right to transfer additional charges to the contracting party and/or the guest without prior notice in the event of a change in law.

(d) The service provider is entitled to set its prices in Hungarian forints and in any convertible currency.

(e) The service provider undertakes to publish its current prices, current promotions, discounts and other offers on the website www.carpediemvendeghaz.hu operated by it.

 

  1. Payment method and guarantee:

(a) The Service Provider shall indicate the total amount of the ordered services, calculated for the entire stay, in the written confirmation sent to the Guest and in the website's booking system.

(b) To finalize the reservation, a payment of 100% of the total amount is required. Payment can be made:

– via the website’s booking system by bank transfer, or

– online payment by bank card through the website's booking system.

(c) The reservation will only be valid upon receipt of the full amount. Otherwise, the reservation will be automatically cancelled.

(d) In the case of bank transfer, the Guest is obliged to make the payment in such a way that the amount is credited to the Service Provider's bank account no later than the day of arrival, or to confirm the fact of the transfer with an irrevocable statement from the account-holding financial institution.

 

  1. How and conditions to use the service:

(a) The guesthouse can accommodate a maximum of 2 people at a time.

(a) The guest may occupy the guesthouse ordered and confirmed by the service provider from 3:00 p.m. on the day of arrival (check in) and must vacate it by 10:30 a.m. on the last day of stay (check out).

(b) In the event that the guest wishes to occupy the guesthouse on the day of arrival before the check-in time specified in point 8(a), this may be done for an additional fee, subject to availability.

(c) The condition for using the Accommodation Service is that the Guests verify their identity in accordance with legal requirements before occupying the guesthouse. No one may live in the guesthouse without notification.

 

  1. Refusal to perform the contract, termination of the service obligation:

The service provider has the right to terminate the accommodation contract with immediate effect or to refuse to provide the service if:

(a) the guest uses the guesthouse provided to him/her for purposes other than those intended, or uses the services provided by the service provider and/or the premises used to provide them for purposes other than those intended, causing damage to them

(b) the guest disrupts the house rules of the guesthouse and does not stop the disruptive behavior despite being asked to do so, and does not comply with the house rules

(c) the guest does not comply with the guesthouse's safety regulations - e.g. smoking in a prohibited area and not stopping despite being asked to do so,

(d) the guest behaves in an objectionable manner, is rude, is under the influence of excessive alcohol or drugs, is threatening, abusive, or exhibits other unacceptable behavior. Incontinent guests and guests who are unable to care for themselves may also not use the services of the guesthouse.

(e) the contracting party or the guest fails to fulfill the payment guarantee deposit payment obligation requested by the service provider by the date specified by the service provider.

(f) the guest suffers from a contagious disease

(g) the guest accommodates additional persons in the guesthouse overnight, in addition to the number of persons specified in the reservation, without notifying and obtaining the permission of the service provider.

(h) If the contract between the contracting parties cannot be fulfilled due to "force majeure", the contract shall be terminated.

(i) The guest uses all services of the guesthouse at his own risk during the entire stay.

 

  1. Provision of services:

(a) If the service provider is unable to provide the ordered services due to its own fault – in particular: overcrowding, temporary operational problems – it will do everything possible to ensure the guest's immediate accommodation.

 

  1. Pets

Pets can be brought to the accommodation after prior arrangement and upon payment of a deposit of 20,000 HUF. The dog can sleep inside in the hallway or in a separate, heated house on the property.

  1. Guest rights:

(a) pursuant to the contract, the guest is entitled to use the ordered guesthouse and the facilities and equipment of the accommodation that are included in the standard range of services and are not subject to the special conditions.

(b) the guest may file a complaint regarding the performance of the services provided by the service provider. The service provider undertakes to investigate the complaint submitted to it in writing or orally on site and recorded in the minutes within 72 hours of receipt of the complaint and to provide the guest with a substantive response.

(c) the Guest's right to complain ceases after leaving the accommodation.

 

  1. Guest's obligations:

(a) the guest is obliged to pay the service provider the consideration for the services ordered in the contract no later than the manner and date specified in the contract.

(b) Before putting into operation any electrical appliances brought into the accommodation by Guests that are not part of the usual travel necessities, the Service Provider's consent must be sought.

(c) the Guest is obliged to immediately report any damage caused to the guesthouse or to him/her to the accommodation provider and to provide the owner with all necessary information that is necessary to clarify the circumstances of the damage or that is necessary for any possible infringement or criminal proceedings.

 

  1. The guest's liability for damages:

(a) the Guest is liable for all damages suffered by the service provider or a third party caused by the guest, his/her companion, or persons under the supervision of any of these persons.

(b) the Guest's obligation to pay compensation also exists if the injured party is entitled to claim compensation for the damage directly from the service provider.

 

  1. The rights of the service provider:

(a) The Service Provider has the right to retain the amount of the 100% accommodation cost received for the accommodation service ordered and finalized by the Guest, but not used by the Guest, as set out in the Cancellation Conditions and the GTC.

(b) if the guest fails to fulfill his obligation to pay for the services used or ordered but not used, the service provider shall have a lien on the guests' property that he brought with him to the guesthouse to secure his claims.

 

  1. The service provider's obligations:

(a) the service provider is obliged to provide the accommodation and other services ordered under the contract in accordance with the applicable regulations and service standards.

(b) the service provider is obliged to investigate the guest's written complaint and take steps to resolve the problem

 

  1. The service provider's liability for damages:

(a) the service provider assumes responsibility for any damage to the guest that occurs within the guesthouse due to its own fault.

(b) the service provider's liability does not extend to damages that occurred due to unavoidable causes beyond the control of the service provider and its guests, or that were caused by the guest or those under his supervision.

(c) the service provider reserves the right to designate a place(s) within the guesthouse where the guest is not allowed to enter. The service provider is obliged to clearly mark such places. The service provider is not liable for any damage that may occur to the guest or to those under his/her supervision in the place(s) where the guest is not allowed to enter.

(d) the service provider is only liable for damages if the Guest reports the damage to the service provider immediately after it occurs, with the necessary information.

(e) the service provider's liability does not extend to the contracting party's luggage and its contents upon arrival and departure, during unloading and loading, and during transport to and from the guesthouse.

(f) the extent of the service provider's liability for damages is a maximum of five times the daily guesthouse price according to the contract.

 

  1. Confidentiality:

(a) when fulfilling its obligations under the contract, the service provider is obliged to act in accordance with the provisions of Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information and the relevant data protection legislation, and if the guest has brought this to the attention of the service provider, the relevant internal rules of the contracting party.

 

  1. Force majeure:

(a) causes or circumstances (e.g. war, fire, flood, inclement weather, power outage, strike, etc.) beyond the control of either the provider, the guest or the contracting party – force majeure – shall exempt either party from performing its obligations under the contract for as long as such cause or circumstance exists. The contracting parties agree to do everything in their power to minimize the possibility of such causes or circumstances occurring and to remedy any damage or delay caused thereby as soon as possible.

 

  1. The law applicable to the legal relationship between the contracting parties and the court of jurisdiction

(a) the provisions of Act V of 2013 on the Civil Code of Hungary shall apply accordingly to the legal relationship between the contracting parties.

(b) for the conduct of litigation related to disputes related to the contract, the contracting parties agree to the exclusive jurisdiction of the Miskolc Court based on submission, or in the absence of its jurisdiction, to the exclusive jurisdiction of the Borsod-Abaúj-Zemplén County Court based on submission.
